The report focuses on addressing current challenges in implementation, which include States’ political unwillingness to implement existing obligations using questionable economic arguments, the inadmissible exclusion of entire categories of victims on the basis of political considerations leading to the perception of biased reparation favouring only one side and the gender insensitivity of a majority of reparation programmes, which results in too few victims of gender-related violations receiving any reparation. The Special Rapporteur urges States to address these challenges and calls on the implementation of a human rights-based approach in the implementation of reparation programmes. The Special Rapporteur emphasizes the importance of the participation of victims in reparation processes, including in relation to the design of programmes, stressing that active and engaged participation may improve a dismal record in the implementation of reparations.
